1. Introduction

These General Conditions of Sale (“Conditions”) govern the purchase and use of data plans associated with electronic SIM cards (“eSIM Data Plans”) provided by Quinta JSC (“we,” “us,” or “our”) with registered address at 94 Tsaribrodska Street, Floor 3, Sofia, Bulgaria, UIC: 206573375 and contact telephone number +359 886 005 657.

By purchasing and activating an eSIM Data Plan, you (“Customer” or “you”) agree to be bound by these Conditions.

By completing your purchase, you expressly consent to the immediate digital delivery of your eSIM and acknowledge that you lose your right of withdrawal under EU consumer protection laws once the eSIM has been issued or activated.

2. Service Description

  • eSIM Technology:
    An eSIM is a digital SIM embedded in your device, allowing activation of a mobile data plan without the need for a physical SIM card.
  • Data Plans:
    Our eSIM Data Plans offer varying data allowances and validity periods. All eSIMs are delivered digitally and activated remotely via QR code or manual activation code.

3. Eligibility and Device Compatibility

  • Device Requirements: You must have an unlocked, eSIM-compatible device. It is your responsibility to ensure compatibility before purchase.

  • Eligibility: We do not provide refunds or replacements for purchases made on incompatible or carrier-locked devices.

4. Purchasing and Activation

  • Purchase Process: eSIM Data Plans can be purchased through our official channels, such as our website or mobile application. Prices and plan details are transparently displayed prior to purchase.
  • Activation: Upon successful payment, you’ll receive instructions to download and install the eSIM. Delivery is considered complete once the QR code or activation details have been sent to the email provided at checkout. Once delivered, the service is deemed “used” and non-refundable.

5. Usage Terms

  • Data Usage: The eSIM Data Plan provides data services only; it does not include voice calls or SMS. Data speeds and availability may vary based on network conditions and device capabilities.
  • Validity Period: Each data plan has a specific validity period, starting from the activation date. Unused data at the end of this period will not carry over or be refunded. It is the customer’s responsibility to activate the eSIM before the expiration of its validity window.

6. Pricing and Payment

  • Pricing: All prices are inclusive of applicable taxes and charges. The total cost of the selected data plan is payable at the time of purchase.
    We reserve the right to suspend transactions suspected of fraudulent activity and to provide transaction data to relevant authorities.
  • Payment Methods: We accept various payment methods as indicated during the purchase process. Ensure that your payment information is accurate to avoid delays.

7. Cancellation and Refunds

  • Cancellation: By purchasing a digital eSIM, you acknowledge that the service is delivered instantly and that you waive your right to withdrawal under Article 16(m) of Directive 2011/83/EU and Article 57(13) of the Bulgarian Consumer Protection Act.
  • Refunds: Refunds are possible only in cases of proven technical failure directly attributable to our system or provider. Once the QR code is issued or eSIM is activated, no refunds will be provided.

  • Refunds: If a refund is required for a card payment made by the customer, the relevant amount will be refunded via a card transaction to the same card used for the payment.

8. Data Protection

  • Privacy:
    By purchasing an eSIM, you agree that activation and device data (ICCID, IP address, activation timestamp) may be processed for fraud prevention and compliance purposes. See our Privacy Policy for details.

9. Limitation of Liability

  • Service Availability:
    We are not responsible for user error during activation, loss of connectivity due to third-party carrier issues, expired or unused plans, or device incompatibility.
  • NoveSIM reserves the right to temporarily or permanently restrict access to its services in cases of unusual activity or suspected malicious behavior by users.

10. Amendments

  • Changes to Conditions: We reserve the right to modify these Conditions.
  • Any changes will be posted on our website with an updated effective date.

11. Governing Law

  • Jurisdiction: These Conditions are governed by and construed in accordance with the laws of Bulgaria and the European Union. Any disputes shall be subject to the competent courts in Sofia, Bulgaria.
